A. Reclamation plans, reports, applications, and other documents submitted pursuant to this title are public records, unless it can be demonstrated to the satisfaction of the Planning Director that the release of such information, or part thereof, would reveal production, reserves, or rate of depletion, and is entitled to protection as proprietary information.

B. The granting authority shall identify such proprietary information as a separate part of the application. Proprietary information shall be made available only to the Director, Department of Conservation and to persons authorized in writing by the operator and by the owner. A copy of all reclamation plans, reports, applications, and other documents submitted pursuant to this title shall be furnished to the Director of the Department of Conservation by the granting authority.
