Any franchise issued pursuant to the provisions of this chapter, shall:

A. Be for the purpose of utilizing the streets for the installation of cables, wires, lines, and other facilities in order to operate a cable television system.

B. Not authorize or be deemed to either expressly or impliedly permit the franchisee, except with the consent of the owners, to provide cable television service to, or install antennae, cables, wires, lines, towers, waveguides, other conductors, converters, or any other equipment or facilities upon private property, including, but not limited to, apartment complexes, condominiums, mobile home parks and residential subdivision developments with private roads.
