A. Any public officer or employee charged with the responsibility for enforcement of the provisions of this chapter may arrest a person with or without a warrant whenever he has reasonable cause to believe that the person to be arrested has committed a misdemeanor in his presence which is in violation of this chapter.

B. In any case in which a person arrested, pursuant to subsection (A) of this section, does not demand to be taken before a magistrate, such public officer or employee making the arrest shall prepare a written notice to appear and release the person on his promise to appear, as prescribed by Chapter 5C (commencing with Cal. Pen. Code § 853.6) of the California Penal Code. The provisions of such chapter shall thereafter apply with reference to any proceeding based upon the issuance of a written notice to appear pursuant to this authority. (Ord. 757, eff. 4/19/90.
