The first and second violation of this chapter (other than SCC 8.08.160 or unless specifically provided in this chapter) shall constitute an infraction. If the owner or person in control of an animal, at the time of the issuance of any citation, has been convicted of a violation of this chapter or has pled no contest to such violations on two occasions within the previous 12 months regarding the same animal, or if there is a violation of SCC 8.08.170(B), then the violation of this chapter may be charged as a misdemeanor.
